January 2013

Systems of privileges appropriate for the different classes of prisoners and the different methods of treatment shall be established at every institution, in order to encourage good conduct, develop a sense of responsibility and secure the interest and co-operation of the prisoners in their treatment. (UNSMR Rule 70)

Remission is the reduction in the length of a prisoner’s sentence, the amount of remission a prisoner may be eligible for will depend upon the length of the prisoner’s single longest sentence.

Inmates within the Zambia Prisons Service get an automatic one-third reduction of their prison term. The only thing that could affect the time deducted from an inmate’s sentence is the inmate’s behavior while still in prison. In other words, remission is also used to ensure good behavior within the prisons by discouraging them from engaging in misconduct.

If a prisoner or detainee is found guilty of a prison offense then the prisoner may lose part or all of his/her remission. Prison officers are empowered in the implementation of this process, but in order to avoid the abuse of such powers, inmates also have the right to an appeal through an adjudication process which includes a fair hearing involving the use of witnesses.
